You Can Now Legally Say “Taco Tuesday”
Taco lovers everywhere, rejoice! The news is out; Taco Bell has won its “Taco Tuesday” trademark battle. Legally we can all say and use the term now! The fast-food giant has taken on its fast-food counterpart, Taco John’s, who claimed the slogan as theirs for the past 34 years.
Taco John’s just announced that it is giving up the trademark.
Tuesday is the day of the week when busy families can swing by their favorite taco spot and get discounted tacos for lunch and or dinner! The problem was nobody could plug it as Taco Tuesday because Taco John’s owned the trademark and no one else, including Taco Bell, was authorized to use it in their advertising, marketing, or promotions.
Fast forward to today. Taco Bell, with a playful gesture, has taken up the challenge and has won wholeheartedly, snatching the rights of “Taco Tuesday” from Taco John’s. The mastermind behind Taco Bell’s success in this challenge, in my opinion, is the NBA Superstar and taco lover, LeBron James. Their creative commercial campaign featuring LeBron trying to say the term and he keeps getting bleeped because it was illegal.

According to NY Post Taco John CEO Jim Creel said “We’ve always prided ourselves on being the home of Taco Tuesday, but paying millions of dollars to lawyers to defend our mark just doesn’t feel like the right thing to do.” In other words…We knew we would lose so we had to just give it away.
Taco Bell’s win is not just their victory but also paves the way for so many other restaurants and food establishments across the country in the future. With the trademark now officially out from under the confines of Taco John’s claws, all fast-food restaurants can advertise their Tuesday discounts without fear of getting sued.
