Lawsuit: Wynn Dealt Blackjack Around Passed Out Player Who Later Died
David Jagolinzer was visiting Las Vegas back in April when he decided to play Blackjack at Wynn Las Vegas. That, according to a newly filed lawsuit, is when his life changed forever.
While David was playing, the suit alleges he suffered cardiac arrest and slumped over, his arm draped on the table. Rather than get medical attention for Jagolinzer, the filing alleges he was left there for over 15 minutes. The dealer allegedly continued to deal out the game to another player at the table.
At one point during the medical episode, casino staff counted his chips according to the Jagolinzer family’s lawyers. According to the suit, it wasn’t until another dealer came to the table that it was noticed he had stopped breathing and his skin was discoloring.
They allege it wasn’t until 20 minutes after Jagolinzer passed out that they attempted to use a defibrillator to revive him but staff wasn’t appropriately trained to use the device.
The lawsuit filed by Christian Morris Trial Attorneys claims the “eye in the sky” (cameras and security personnel) witnessed the episode and did nothing to assist.
Jagolinzer later died due to Wynn Las Vegas’ inaction, the lawsuit alleges
Jagolinzer suffered significant brain injury due to the lack of oxygen, his lawyers say. This resulted in his death in October from anoxic encephalopathy, which is when the brain tissue ceases to receive blood flow. The lawsuit claims this was brought on by the medical episode, and failure to tend to him immediately upon his collapse.

The civil suit alleges wrongful death and negligence among other things and is seeking north of $15,000 in damages. Wynn Las Vegas says they will defend itself against what they are calling false accusations made in the lawsuit.
